Implementation Status/Rulemaking:   

EPA submitted an interim determination to the Federal Highway Administration (FHWA) and the General Services Administration (GSA) on December 22, 2022, stating that “substantially lower” levels of global warming potential should be defined as the top 20% as when compared to similar materials/products. If these products/materials are not available in a project’s location, then it should be defined as the top 40%. If these products/materials still are not available, then the global warming potential requirement should be better than the estimated industry average. Source
